ELIGIBILITY: Weight Watchers® Smart Ones®
Fruitastic Recipe Contest is open to the General Public.
Contest is open to persons who are at least 18 years of age (at the time of
entry), and who are legal U.S. residents, living within the fifty (50) United
States. Employees, directors and officers of Sponsor, its parent company, their
respective affiliates, subsidiaries, divisions, agents, distributors,
individuals engaged in the development, production or distribution of contest
materials, advertising and promotion agencies, and Promoter, and their
immediate families (spouse, parents, children, siblings, and their respective
spouses), and the respective household members, are not eligible to
participate. Contest is subject to all federal, state, and local laws. U.S. law
governs this Promotion. Contest void in APO/FPOs, Puerto Rico & where
prohibited, taxed or restricted by law. Sponsor reserves the right to
disqualify participants who violate these Official Rules or interfere with this
Contest in any manner. If a participant is disqualified, Sponsor reserves the
right to terminate that participant's eligibility to participate in the
Contest.
HOW TO ENTER: Create a recipe for an
entrée, using at least one fruit, and write a maximum 300 word description
explaining how the recipe satisfies your cravings. To enter your recipe in the
Contest, log on to www.eatyourbest.com ("Web Site") between 12:00:01
am ET on 1/01/08 and 11:59:59 pm ET on 6/01/08 ("Contest Entry
Period"), click on the "Enter Our Recipe Contest" link and
follow the entry process. By entering, each entrant constitutes permission to
use their entries (recipes and descriptions), and their names and likenesses
for publicity purposes without further compensation in any and all media now
known or hereinafter without territorial restriction (except where prohibited
by law).
RECIPE REQUIREMENTS: Recipe must be an
entrée and ingredients must include one (1) or more fruit(s). Recipe must be
accompanied by a maximum 300 word essay description (written in English) of how
the recipe satisfies your cravings. Recipe must be original and may not have
been published or previously entered in any other contest. All entries will be
initially screened by representatives of the Sponsor to assure, at their sole
discretion, that recipe and description meet the criteria and requirements as
set forth in these official rules. Submission of an entry grants Sponsor and
its agents the right to publish, use, adapt, edit and/or modify such entry in
any way, in any and all media, without limitation, and without consideration to
the entrant. Submission of any entry further constitutes the entrant's consent
to irrevocably assign and transfer to the sponsor any all rights, title and
interest in the entry, including, without limitation, all copyrights.
PRIZES: One (1) Grand Prize winner
will receive a check for $5,000 and a trip for two to Los Angeles, California,
that includes round trip coach class airfare from a major commercial airport
near winner's residence and two (2) night's accommodation (double occupancy) to
enjoy a cooking experience with chef and flavor Guru Devin Alexander (subject
to her availability). The winning recipe will be the inspiration for a new
Weight Watchers® Smart Ones® Fruit InspirationsT product. The author of
the winning recipe concept and his/her hometown will be identified on the
Weight Watchers® Smart Ones® Fruit Inspirations™ packaging inspired by the winning
recipe, and published at www.eatyourbest.com.
The Approximate Retail Value of the Grand prize is $10,000. Four (4) Runners
Up: Each runner up will receive a $1,000 check. Taxes and expenses that are not
specified relating to acceptance and use of prize are the responsibility of the
winner. Sponsor does not guarantee that the product inspired by the winning
recipe will achieve national distribution levels.
SELECTION OF WINNERS: Entries will be
judged by a qualified panel of judges based on the following criteria:
(#1) Perceived Taste of Entrée Based on Recipe (50%) (recipes will not be
prepared)
(#2) Nutrition (health and wellness) (25%)
(#3) Creativity (25%)
Judges will include independent chefs and Sponsor representatives. All judges'
decisions are final and binding. In the event of a tie, the tie will be broken
based on the highest score for Perceived Taste. The Grand Prize winner and
Runners Up will be announced on or about 6/30/2008. Upon verification, winners
will be notified by mail, email, or telephone of their selection. Prize claims
are subject to official verification and compliance with these Official Rules.
Winners will be required to sign a recipe release and waiver, a release of
liability and a publicity consent agreement within 7 days of notification or
prize may be forfeited. If the selected winner cannot be contacted, or if prize
notification is returned as undeliverable, winner is ineligible or fails to
claim the prize, an alternate winner may be selected.
AGREEMENT TO OFFICIAL RULES/RELEASES: Winners
and all participants (1) agree to abide by and be bound by these Official Rules
and all decisions of the independent judging organization, which are final and
binding in all respects; (2) release and agree to hold harmless HJ Heinz
Company L.P., its agencies, their respective parents, affiliates, and
subsidiaries, and the directors, officers, agents, representatives,
shareholders and employees of any of the above entities, and any successors
and/or assigns of any of the above entities, from any and all liability arising
(directly or indirectly, in whole or in part) from participation in the Contest
or the acceptance, receipt, possession or use/misuse of any Prize. By accepting
a Prize, winner agrees to the Sponsor's use of his/her name, address,
photograph or likeness for advertising or publicity purposes, and any and all
rights to said use, without notice or further compensation, except where
prohibited by law.
ADDITIONAL TERMS: VERIFICATION: All recipes are subject to
verification. Any attempt to defraud Sponsor or the official judging agency in
any way will be prosecuted to the fullest extent of the law.
In no event will Sponsor be obligated to award more than the stated number of
prizes. Neither Sponsor, Administrator nor their agents are responsible for
lost, interrupted or unavailable network, server, satellite, or other
connections, availability or accessibility; or miscommunications, failed
computer, telephone or cable transmissions, lines, or technical failure; or
jumbled, scrambled, delayed, or misdirected transmissions, computer hardware or
software malfunctions, failures or difficulties; or any other errors of any
kind whether human, mechanical, electronic or network or the incorrect or
inaccurate capture of entry or other information or the failure to capture, or
loss of, any such information. Persons who tamper with or abuse any aspect of
the Contest, as solely determined by the Sponsor, will be disqualified, and
Sponsor reserves the right to terminate such entrant's eligibility. Should any
portion of the Contest be, in Sponsor's sole opinion, compromised by virus,
worms, bugs, non-authorized human intervention or other causes which, in the
sole opinion of the Sponsor, corrupt or impair the administration, security,
fairness or proper play, or submission of entries, Sponsor reserves the right
at its sole discretion to modify, suspend or terminate the Contest. Sponsor is
not responsible for any incorrect or inaccurate information, whether caused by
site users, tampering, hacking, or by any equipment or programming associated
with or utilized in the Contest, and assumes no responsibility for any error,
interruption, deletion, defect, delay in operation, or transmission,
communications line failure, technical failure, theft or destruction, or
unauthorized use in connection with the purchase transaction entry portion or
any other portion of the Contest.
In no event will Sponsor, its parent, affiliates, subsidiaries and related
companies, their respective advertising or promotion agencies or any of their
respective Officers, Directors, Employees, Representatives and agents, be
responsible or liable for any damages or losses of any kind, including direct,
indirect, incidental, consequential or punitive damages arising out of your
access to and use of the website or downloading from and/or printing material
downloaded from www.eatyourbest.com or any other website associated with this
Contest. Without limiting the foregoing, everything on the website is provided
"as is" without warranty of any kind, either express or implied, including, but
not limited to, implied warranties of merchantability, fitness for a particular
purpose or non-infringement. Some jurisdictions may not allow limitations or
exclusion of implied warranties so some of the above limitations or exclusions
may not apply to you. Check your local laws for any restrictions or limitations
regarding these limitations or exclusions.
